Employment claim against Allstate Insurance Company of Canada and The Allstate Corporation

This is an employment class action brought on behalf of approximately 350-450 agents in Ontario who, it is alleged, were constructively dismissed by Allstate.  On July 24, 2007 Allstate unilaterally announced substantive material changes to the employment contract terms with the class members to be implemented September 1, 2007.  These changes stripped class members of their renewal books of business and closed numerous agent locations throughout Canada, consolidating the locations, and replacing them with "Allstate Insurance Agency" offices.  Class members' compensation system changed as did many of their other terms of employment. 

The claim is for constructive dismissal, as well as breach of Ontario's Employment Standards Act.  Class members will be those Ontario agents who did not accept the unilateral substantive changes to the employment relationship and who were forced to leave their employment with Allstate.  The court has yet to determine the precise class definition.
